This Credit Information Authorization explains when and how Biz Capital Depot LLC (“Biz Capital Depot,” “we,” “us,” or “our”) and participating Financing Providers may obtain and use credit information about you and your business. It applies when you check an authorization box, sign, or otherwise give your consent in an Application or form that refers to this Authorization.
1. Your Authorization
When you provide this authorization, you are giving Biz Capital Depot LLC written instructions under the Fair Credit Reporting Act (“FCRA”) to obtain information from your personal credit profile and other information from one or more consumer reporting agencies, such as Equifax, Experian, or TransUnion, for the purpose of:
- Evaluating your eligibility for financing programs and products you requested
- Identifying Financing Providers whose requirements may match your credit profile
- Preparing and submitting financing applications that you have authorized
- Verifying your identity and preventing fraud
If you apply on behalf of a business, you also authorize us to obtain business credit reports and related information about that business from business credit reporting agencies.
2. Soft and Hard Inquiries
Unless we tell you otherwise before you authorize it, any credit information Biz Capital Depot LLC obtains for prequalification or matching is requested as a “soft” inquiry, which does not affect your credit score.
Financing Providers that you choose to apply with may perform a “hard” inquiry as part of their underwriting, which may affect your credit score. Financing Providers are responsible for obtaining any authorization they require and for providing you with their own disclosures before performing a hard inquiry. Please review those disclosures carefully before you agree.
3. Sharing With Financing Providers
You authorize Biz Capital Depot LLC to share your Application, your credit information, and supporting documents with participating Financing Providers for the purpose of seeking the financing you requested, and you authorize those Financing Providers to obtain credit information about you and your business in connection with your Application, subject to applicable law.
4. Limits on Use
Credit information obtained under this Authorization will be used only for the purposes described above and as permitted by the FCRA and other applicable law. We will not use it for unrelated purposes or sell it.
5. Duration and Revocation
This Authorization remains in effect for as long as your Application or request for Services is active, or until you revoke it. You may revoke this Authorization at any time by emailing contact@bizcapitaldepot.com with “Revoke Credit Authorization” in the subject line. Revocation does not affect inquiries made before we received your request, and Financing Providers that have already received your Application may have separate authorizations from you.
6. Your Rights Under the FCRA
You have rights under the FCRA, including the right to know what is in your credit file, to dispute incomplete or inaccurate information, and to obtain a free copy of your credit report from each of the nationwide consumer reporting agencies once every 12 months at AnnualCreditReport.com. A summary of your rights is available from the Consumer Financial Protection Bureau at consumerfinance.gov.
If a Financing Provider takes adverse action based in whole or in part on information in a credit report, that Financing Provider is responsible for providing the notices required by law.
