These Terms of Application apply whenever you submit a funding request, qualification form, funding application, aged corporation order or registration, or any other application or form (each, an “Application”) to Biz Capital Depot LLC (“Biz Capital Depot,” “we,” “us,” or “our”) through our websites, by telephone, or by any other method.
These Terms of Application supplement our Terms of Use and Privacy Policy. By submitting an Application, you agree to these Terms of Application.
1. Who May Apply
You must be at least 18 years of age and a resident of the United States to submit an Application. If you apply on behalf of a business, you represent that you are an owner, officer, member, or other person authorized to act for and bind that business, and that the business is legally organized and in good standing.
2. Accuracy of Information
You certify that all information and documents you provide in or with an Application are true, accurate, current, and complete, and that you will promptly notify us of any material change. This includes your identity, contact details, income, business revenue, ownership, debts, and any supporting documents.
You understand that knowingly providing false or misleading information in connection with a credit application may violate federal and state law, and that Biz Capital Depot LLC and Financing Providers may decline, withdraw, or cancel any request or financing that is based on inaccurate information.
3. Authorization to Verify and Share Information
By submitting an Application, you authorize Biz Capital Depot LLC to:
- Review the information and documents you provide
- Verify your identity and the information in your Application, including through third-party identity verification and fraud prevention providers
- Contact you about your Application and potential financing options
- Share your Application and supporting documents with participating Financing Providers that may be able to offer the financing you requested
- Share your information with service providers that help us process your Application, as described in our Privacy Policy
Access to consumer credit reports is governed by our separate Credit Information Authorization and applicable law.
4. Financing Providers Make All Credit Decisions
Biz Capital Depot LLC is not a bank or direct lender. Submitting an Application does not guarantee that you will be matched with a Financing Provider, receive an offer, or be approved for any particular amount, rate, or term.
Each Financing Provider makes its own decisions using its own underwriting criteria. A Financing Provider may ask you to complete its own application, provide additional documents, agree to its own terms and disclosures, and authorize its own credit inquiries. Any financing you accept is a contract between you and that Financing Provider.
Amounts, timeframes, and credit score requirements described on our websites are general program descriptions and estimates. They are not offers of credit and may change without notice.
5. Fees and Separate Agreements
Submitting an Application is free unless a fee is clearly disclosed to you before you submit it. Some Services, such as application assistance, funding facilitation, business credibility buildout, or aged corporation services, are provided under a separate service agreement or order form that discloses the applicable fees. You will not be charged for those Services unless you agree to that separate agreement or expressly authorize the charge.
Third-party products and services purchased on your behalf with your authorization are subject to the amount and purpose you authorized.
6. Documents You Upload
Documents you upload, such as identification, Social Security cards, bank statements, tax returns, or business formation documents, are used only to verify your information, process your Application, and provide the Services you requested. We store sensitive information using access controls and encryption appropriate to its sensitivity, as described in our Privacy Policy. Please upload only documents that you are authorized to share.
7. Communications About Your Application
You agree that we may contact you about your Application at the email address and telephone numbers you provide. Marketing calls and text messages are sent only with your consent, as described in our Consent to Telephonic Communications. You also agree to receive records and disclosures electronically as described in our Electronic Disclosure and Consent.
8. Withdrawing an Application
You may withdraw an Application at any time by emailing contact@bizcapitaldepot.com or calling (800) 276-8870. Withdrawing an Application does not cancel applications you have already submitted directly to a Financing Provider or obligations you have accepted under a separate agreement. Information already shared with Financing Providers is subject to their own policies.
